1. Acceptance of Terms

By accessing and using ExpenseIQ ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of ExpenseIQ, a fleet management and expense tracking platform provided by LOFA Group ("we," "us," or "our").

2. Description of Service

ExpenseIQ is a comprehensive fleet management platform that enables businesses to track and manage:

  • Fuel consumption and expenses
  • Vehicle maintenance records and costs
  • Vehicle inspections and compliance
  • Accident reports and documentation
  • Fleet analytics and reporting
  • Notification and alert management

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and identification
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this section.

4. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any robot, spider, or other automatic device to access the Service
  • Upload or transmit any viruses, worms, or malicious code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

5. Data and Content

You retain ownership of all data and content you upload or enter into the Service ("Your Content"). By using the Service, you grant us:

  • A worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing the Service
  • The right to use aggregated and anonymized data for analytics, improvement of the Service, and other business purposes

You are solely responsible for Your Content and the consequences of uploading or posting it. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by LOFA Group and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

7. Payment and Billing

If you purchase a subscription or other paid features, you agree to pay all fees associated with your account. Payment terms, pricing, and billing cycles will be specified at the time of purchase.

  • All fees are non-refundable unless otherwise stated
  • We reserve the right to change our pricing with 30 days' notice
  • You are responsible for any taxes applicable to your use of the Service
  • Failure to pay may result in suspension or termination of your account

8. Service Availability

We strive to provide reliable and continuous access to the Service. However, we do not guarantee that the Service will be available at all times or that it will be error-free. The Service may be temporarily unavailable due to:

  • Scheduled maintenance or updates
  • Technical issues or failures
  • Circumstances beyond our reasonable control

We are not liable for any loss or damage resulting from Service unavailability.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and all associated data
  • You remain responsible for all charges incurred prior to termination

You may terminate your account at any time by contacting us or using the account deletion features in the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of correctness, accuracy, reliability, or otherwise.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LOFA GROUP, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless LOFA Group and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Puerto Rico.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date at the top of this page
  • Sending an email notification to registered users (for significant changes)

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and may terminate your account.
